2. How we collect Personal Information

(1) When a User registers for use, the Management Office may request Personal Information such as name, date of birth, address, telephone number, e-mail address, and credit card number. In addition, transaction records including the User’s Personal Information and information related to payments made between the User and the alliance partners may be collected from the Management Office’s alliance partners (including information providers, advertisers, and advertisement distributors, hereinafter referred to as “Alliance Partner”).

(2) The Management Office will not collect or acquire Personal Information by deception or other wrongful means.

3. Purpose of collecting and using Personal Information

The purposes for which the Management Office collects and uses Personal Information are as follows:
1) To provide and manage the Management Office’s services
2) To respond to inquiries from Users (including identity verification)
3) To send email notifications about new features, updates, campaigns, etc. of the Service the User is using, as well as information on other Services provided by the Management Office
4) To contact the User as necessary for maintenance, important notices, etc.
5) To identify Users who have violated the Terms of Use or who are attempting to use the Service for illegal or unjust purposes, and to refuse their use of Service
6) To allow Users to view, change, or delete their own registration information, or to view the status of their use of Service
7) To bill Users for paid Services

4. Change of purpose of use

The Management Office shall change the purpose of use of Personal Information only when it is reasonably recognized that the purpose of use is related to the purpose of use before the change. In the event that the purpose of use is changed, the Management Office shall notify the User or publicly announce on the website the updated purpose of use by the method determined by the Management Office.

5. Provision of Personal Information to Third Parties

1) Except in the following cases, the Management Office will not provide Personal Information to a third party without the prior consent of the User. In order to prevent leakage of Personal Information, the Management Office will properly manage such information in accordance with the Management Office’s Personal Information Protection Policy. However, this does not apply to cases permitted under the Personal Information Protection Law or other laws and regulations.

a) Cases in which the provision of Personal Information is necessary for the protection of life, body, or assets of an individual and in which it is difficult to obtain the consent of the individual

b) Cases in which the provision of Personal Information is particularly necessary for improving public health or promoting the healthy growth of children and in which it is difficult to obtain the consent of the individual

c) When it is necessary to cooperate with a national agency, a local government, or an individual or entity entrusted by either a national agency or the local government to execute affairs stipulated by law, and when obtaining the consent of the individual is likely to hinder the execution of the affairs concerned

d) When the following matters are notified or publicized in advance, and when the Management Office notifies the Personal Information Protection Committee

i) Purposes of use include provision to third parties
ii) Data items provided to third parties
iii) Means or method of provision to third parties
iv) Stopping the provision of Personal Information to third parties at the request of the individual
v) Accepting the request of the individual
vi) The name and address of the Entities Handling Personal Information and in the case of a corporation, the name of the representative is to be provided to the third party (if the organization is not a corporation but has a designated representative or administrator, the name of the representative or administrator. The same shall apply hereinafter in this Article, Article 30, Paragraph 1, Item 1 and Article 32, Paragraph 1, Item 1).
vii) The method of obtaining personal data provided to third parties
viii) Matters stipulated by the Personal Data Protection Commission Regulations necessary to protect the rights and interests of individuals or two of the following:

e) Where the Entities Handling Personal Information is an academic research institution, etc., and the provision of personal data is unavoidable for the publication of the results of academic research or for teaching (except where there is a risk of unjustified infringement of the rights and interests of individuals)

f) Where the Entities Handling Personal Information is an academic research institution, etc., and it is necessary to provide personal data for academic research purposes (including cases where a part of the purpose of providing personal data is for academic research purposes, but excluding cases where there is a risk of unreasonably infringing on the rights and interests of individuals). (limited to cases where the Entities Handling Personal Information and the third party concerned conduct a joint academic research)

g) Where the third party is an academic research institution, etc., and it is necessary for the third party to handle the personal data for academic research purposes (including cases where part of the purpose of handling personal data is for academic research purposes, but excluding cases where there is a risk of unreasonable infringement of the rights and interests of individuals).

2) Notwithstanding the preceding paragraph, the recipient of such information shall not fall under the category of a third party in the following cases:

a) When the Management Office outsources all or part of the handling of Personal Information within the scope necessary to achieve the purpose of use

b) Cases in which personal data is provided as a result of the succession of business due to merger or other reasons
(i) Cases in which personal data that is jointly used with a specific individual is provided to the specific individual concerned, the items of personal data to be jointly used, the scope of the joint Users, the purpose of use by the User, the name and address of the person responsible for managing the personal data, the corporation and the name of its representative are notified in advance to the individual concerned or they are readily accessible.

c) When providing personal data to a third party located in a foreign country, the Management Office will take necessary measures, such as obtaining consent in accordance with applicable laws and regulations.

6. Disclosure of Personal Information

1) Except in the following cases, the Management Office will not provide Personal Information to a third party without the prior consent of the User. In order to prevent leakage of Personal Information, the Management Office will properly manage such information in accordance with the Management Office’s Personal Information Protection Policy. However, this excludes cases permitted under the Personal Information Protection Law and other laws and regulations.

a) When there is a risk of harm to life, body, assets, or other rights or interests of the person concerned or a third party
b) When there is a risk of significant hindrance to the proper conduct of the Management Office
c) When it would violate other laws and regulations

2) Notwithstanding the provisions of the preceding paragraph, in principle, the Management Office will not disclose any information other than Personal Information such as web history and visitor’s movement information.

3) The User or his/her representative may request disclosure or notification of the purpose of use of Personal Information that identifies the User in accordance with the procedures implemented by the Management Office. For specific information on how to make such a request, please inquire through our Contact Form listed in Section 9 “How to contact us for disclosure, correction, deletion, or other inquiries regarding Personal Information.”

7. Correction and deletion of Personal Information

1) When the User’s Personal Information held by the Management Office is incorrect, the User may request the Management Office to correct, add, or delete the Personal Information (hereinafter referred to as “correction, etc.”) in accordance with the procedures implemented by the Management Office.

2) When the Management Office determines that it is necessary to respond to a User’s request in accordance with the preceding paragraph, the Management Office will make corrections, etc. to Personal Information without delay.

3) The Management Office will notify the User without delay when it corrects or decides not to correct Personal Information in accordance with the provisions of the preceding paragraph.

8. Suspension of Use of Personal Information, etc.

1) When the individual requests the suspension of use or deletion (hereinafter referred to as “suspension of use, etc.”) of his/her Personal Information for any of the following reasons: the Personal Information is handled in a manner that exceeds the scope of the purpose of use, or the Personal Information was obtained through wrongful means. If a request is made for suspension of use or deletion (hereinafter referred to as “suspension of use, etc.”) of Personal Information for any of the following reasons: that the information is handled beyond the scope of the purpose of use; or that the information was obtained by wrongful means. c) When there is a risk that the rights or legitimate interests of the individual concerned may be harmed by the handling of the retained personal data, such as when the retained personal data has been leaked, etc.

2) If, based on the results of the investigation described in the preceding paragraph, we determine that it is necessary to comply with the request, we will suspend the use of the Relevant Personal Information without delay. After confirming that the request is made by the User himself/herself, we will suspend the use of the Personal Information without delay and notify the customer to that effect. However, this shall not apply in cases where the Management Office is not obligated to suspend the use of Personal Information under the Personal Information Protection Law or other laws and regulations.

3) When the Management Office suspends the use of Personal Information in accordance with the preceding paragraph or decides not to suspend the use of Personal Information, the Management Office will notify the User of such decision without delay.

4) Notwithstanding the preceding two paragraphs, in cases where it is difficult to take alternative measures to protect the rights and interests of the User, such as when the suspension of use involves a large amount of expense or when it is otherwise difficult to take such measures, such alternative measures shall be taken.

9. How to contact us for disclosure, correction, deletion, or other inquiries regarding personal information

If you request disclosure, correction, or deletion of your personal information, we will promptly respond to your request after confirming your identity.
